Terms of Service for GiftCountdown

1. Acceptance of Terms

Welcome to GiftCountdown ("the App," "we," "us," or "our"). By downloading, installing, accessing, or using GiftCountdown, you ("User," "you," or "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

These Terms constitute a legally binding agreement between you and Keeping up with technology Pty Ltd. We reserve the right to modify these Terms at any time. We will indicate changes by updating the "Last Updated" date above. Continued use of the App after changes are posted constitutes acceptance of the modified Terms.

2. Description of Service

GiftCountdown is a free-to-use mobile application that provides tools to manage gift-giving and special events, including:

• Event Tracking: Visual countdowns for birthdays, anniversaries, and holidays.
• Gift Management: Organising gift ideas, tracking delivery statuses (Idea → Purchased → Wrapped → Shipped → Delivered), and managing budgets.
• Trending Gift Shuffle: A discovery tool to find curated gift ideas based on age group and gender.
• Calendar Synchronisation: Integration with your device's native iOS Calendar to import and export events.
• Birthday Age Calculations: Automated age tracking for upcoming milestone celebrations.
• Style Request (Optional): A feature that generates a shareable web form link so a contact can submit their clothing sizes and interests to help you choose a better gift.

3. The Style Request Feature

3.1 How It Works

The Style Request feature allows you to send a personalised link to a contact (the "recipient"). When the recipient completes the web form, their preferences (gender, clothing sizes, and interests) are temporarily stored on our Supabase backend and then retrieved by your app.

3.2 Your Responsibilities as the Requester

By using the Style Request feature, you agree to:

• Only send Style Request links to individuals who have given you their implied or explicit consent to share their sizing and preference information with you for the purpose of gift-giving.
• Not use the feature to collect data from minors under the age of 13.
• Not misrepresent the purpose of the link to the recipient.
• Not use the collected information for any purpose other than personal gift planning.

3.3 Recipient Acknowledgement

By submitting a Style Request form, the recipient acknowledges that:

• Their submitted preferences (gender, clothing sizes, size region, interests) will be shared with the GiftCountdown user who generated the link.
• The data will be stored temporarily on Supabase servers (max 7 days) before being imported into the requester's app and then deleted from our servers.
• This submission is voluntary.

3.4 Data Handling

Supabase is used as a temporary relay. We do not use the submitted data for marketing, profiling, or any purpose other than delivering it to the requesting app. Full details are in our Privacy Policy.

4. Subscription and Tipping Terms

4.1 "Tip the Developer" (Optional Support)

GiftCountdown is provided entirely free of charge. We offer an optional "Tip the Developer" system to allow users to support the project.

• Voluntary Contributions: Tipping is entirely voluntary and is not required to access any part of the App.
• No Impact on Functionality: Providing a tip does NOT unlock additional features, remove any limitations, or change the App's core functionality. All users have access to the full suite of features regardless of whether they choose to tip.
• One-Time Tips: These are non-consumable in-app purchases processed through the Apple App Store.

4.2 Payment Processing

All financial transactions are processed through the Apple App Store using your Apple ID and the native Apple StoreKit framework.

By making a purchase, you agree to the Apple Media Services Terms and Conditions. We do not store or have access to your credit card or financial information.

4.3 Cancellation and Refund Policy

• Final Sale: All in-app purchases and tips are final and non-refundable, except as required by Australian Consumer Law or at Apple's sole discretion.
• Refund Requests: Must be submitted directly to Apple via Report a Problem. We cannot issue refunds directly.

5. User Accounts and Privacy

5.1 No Account Required

GiftCountdown is designed as a local-first application. You are not required to create an account to use any feature of the App.

5.2 Device Identity

The app generates and stores a random, anonymous App Install ID in your device's secure Keychain. This ID is used solely to match Style Request responses back to your app installation. It does not contain or link to any personal identifying information.

5.3 Data Responsibility

Since your primary data is stored locally on your device, you are responsible for maintaining backups. We are not liable for any data loss resulting from device failure, app deletion, or any other cause outside our control.

5.4 Third-Party Data Hosting

The Style Request feature uses Supabase as a temporary data relay. While we take reasonable steps to secure this data (including HTTPS encryption and Row Level Security on the database), you acknowledge that no third-party service can guarantee absolute security. By using the Style Request feature, you accept this risk.

6. Acceptable Use

You agree NOT to:

• Use the App for any illegal or unauthorised purpose.
• Attempt to reverse engineer, decompile, or extract source code from the App.
• Use automated systems (bots, scrapers) to access Trending Gift data.
• Abuse the tipping system or attempt to circumvent in-app purchase requirements.
• Use the Style Request feature to collect data from individuals without their knowledge or consent.
• Use the Style Request feature to collect data from children under the age of 13.
• Attempt to access, modify, or tamper with Style Request data belonging to other users via the Supabase API.

7. Disclaimers and Limitations of Liability

7.1 No Liability for Third-Party Goods

WE ARE NOT A RETAILER.

GiftCountdown suggests gift ideas and may provide inspiration referencing third-party products. We do not guarantee:

• The quality, safety, or legality of any gift item mentioned in the app.
• The accuracy of prices or availability of any product.
• The successful delivery of gifts purchased from third parties.
• Any damage or loss resulting from transactions with third-party vendors.

7.2 Service Accuracy

While we strive for accuracy, we do not guarantee:

• That birthday and age calculations will always be correct (please verify milestone dates).
• That "Trending Gift" suggestions will be suitable for your specific recipient.
• That the App will be free from bugs or service interruptions.
• That the Style Request web form will be available 100% of the time, as it depends on third-party infrastructure (Supabase, GitHub Pages).

7.3 Third-Party Services

The Style Request feature relies on third-party services (Supabase for data storage, GitHub Pages for the web form). We are not responsible for any outage, data loss, or policy change by these providers that affects the feature's availability or functionality.

7.4 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KEEPING UP WITH TECHNOLOGY PTY LTD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, INCLUDING PERSONAL INJURY OR PROPERTY DAMAGE, ARISING FROM YOUR USE OF THE APP, THE STYLE REQUEST FEATURE, OR THE PURCHASE OF GIFTS TRACKED WITHIN THE APP.

8. Intellectual Property

The GiftCountdown app, including its "Style Request" system, "Trending Gift Shuffle" logic, visual design, and branding, is owned by Keeping up with technology Pty Ltd. You are granted a limited, personal, non-transferable licence to use the app for its intended purpose.

9. Dispute Resolution

9.1 Governing Law

These Terms are governed by the laws of Australia. You agree that any legal action arising from these Terms shall be filed in the courts located in Australia.

9.2 Informal Resolution

Before taking legal action, you agree to contact us at office@keepingupwithtechnology.com to attempt to resolve the issue informally within 60 days.

10. Changes to These Terms

We may update these Terms from time to time. We will indicate changes by updating the "Last Updated" date at the top. The version number in the footer also increments with each revision. Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms.
