1. Acceptance of Terms
Welcome to RememberPeople ("the App," "we," "us," or "our"). By downloading, installing, accessing, or using RememberPeople, you ("User," "you," or "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.
These Terms constitute a legally binding agreement between you and Keeping up with technology Pty Ltd, the developer of RememberPeople. Continued use of the App after changes to these Terms constitutes acceptance of the modified Terms.
2. Description of Service
RememberPeople is a personal relationship memory application that helps you remember important details about people you meet. The App provides:
- Contact profiles with fact-tagging and relationship mapping
- Spaced-repetition memory quizzes to strengthen recall of people
- Location-anchored meeting notes that link people to the places you met them
- Voice recording and on-device transcription for meeting notes
- Geofence-based reminders when you return to a location where you previously met someone
- CRM-style interaction logging (calls, emails, meetings, and more)
- Group and organisation management for your contacts
- LinkedIn Connections CSV import to create contact profiles from your exported LinkedIn connections
- An in-app LinkedIn profile browser that lets you capture a person's name, role, and company directly from their LinkedIn profile page
All data you create in the App is stored on your device. If iCloud is enabled on your device, data may also sync to your personal iCloud account via Apple's CloudKit service.
3. Account and iCloud
3.1 No Developer Account Required
RememberPeople does not require you to create an account with us. There is no username, password, or developer-managed profile.
3.2 iCloud Sync
If you enable iCloud for RememberPeople on your device, your data will sync across your devices via your personal Apple ID and iCloud account. This is governed by Apple's Terms of Service and Privacy Policy:
We do not control, access, or have visibility into data stored in your iCloud account.
3.3 Data Responsibility
Because your data is stored on your device and your personal iCloud account, you are responsible for:
- Maintaining and backing up your data
- Managing iCloud storage for the App
- Ensuring your device is secured with a passcode or biometric lock
4. Acceptable Use
4.1 Permitted Use
You may use the App for personal, non-commercial purposes in accordance with these Terms and applicable laws.
4.2 Prohibited Conduct
You agree NOT to:
- Violate any applicable laws or regulations
- Infringe on the privacy or intellectual property rights of others
- Use the App to store information about individuals without a lawful basis to do so
- Transmit viruses, malware, or harmful code
- Attempt to gain unauthorised access to our systems or Apple's CloudKit infrastructure
- Reverse engineer, decompile, or disassemble the App
- Use the App to track, monitor, or surveil individuals without their knowledge or consent
- Use the App for commercial data collection, profiling, or resale purposes
- Remove proprietary notices or branding from the App
- Permit others to use the App under your account
- Use the LinkedIn features in violation of LinkedIn's User Agreement or any applicable LinkedIn terms; in particular, you must not use the in-app LinkedIn browser or CSV import to scrape, harvest, or process LinkedIn data in ways that violate LinkedIn's terms
4.3 Responsible Contact Data Use
RememberPeople is designed for personal use to help you remember people in your own life. You are responsible for:
- Ensuring you have an appropriate lawful basis for storing personal information about individuals in the App (e.g., the information is about people you have a genuine personal or professional relationship with)
- Complying with applicable data protection laws in your jurisdiction when using the App
- Not using the App to collect, aggregate, or process personal data in ways that would require additional legal compliance obligations you have not fulfilled
5. Device Permissions
The App requests certain device permissions to enable its features (location, microphone, contacts, notifications, camera). You can grant or revoke these permissions at any time in your iOS device settings. Revoking a permission disables the corresponding feature but does not affect data already stored.
We are not liable for any loss of functionality resulting from your choice to deny or revoke permissions.
6. Notifications
6.1 Local Notifications Only
All notifications sent by RememberPeople are local notifications generated on your device. We do not send remote push notifications from a developer-operated server.
6.2 Notification Types
The App may deliver:
- Spaced-repetition memory review reminders ("Memory Check")
- Geofence arrival nudges when you return to a location where you previously met someone
6.3 Controlling Notifications
You can disable notifications at any time via Settings → Notifications → RememberPeople on your iOS device, or within the App's settings.
7. Intellectual Property
7.1 Ownership
All content, features, and functionality of the App, including but not limited to:
- Software code and algorithms (including the spaced-repetition engine)
- User interface design and visual elements
- App icons, logos, and branding
- Trademarks
are owned by Keeping up with technology Pty Ltd or our licensors and are protected by copyright, trademark, and other intellectual property laws.
7.2 Limited Licence
We grant you a limited, non-exclusive, non-transferable, revocable licence to:
- Download and install the App on Apple devices you own or control
- Use the App for personal, non-commercial purposes
This licence does not permit you to modify, copy, extract source code, or remove proprietary notices.
7.3 Your Content
All contact profiles, meeting notes, voice recordings, interaction logs, and other data you create in the App remain your property. By using the App, you grant us no licence to your content — we do not access, process, or use it.
8. Privacy and Data
8.1 Privacy Policy
Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
8.2 No Developer Data Collection
We do not operate servers that collect or process your personal data. All data you enter into RememberPeople stays on your device and, if iCloud is enabled, in your personal iCloud account. We cannot read, access, or use your data.
9. Third-Party Services
9.1 Apple Services
The App uses various Apple frameworks (CloudKit, CoreLocation, Speech, Vision, Contacts, MapKit, UserNotifications, WebKit), each subject to Apple's Terms and Privacy Policy.
9.2 LinkedIn
The App includes an optional in-app browser for viewing LinkedIn profiles and a CSV import tool for LinkedIn connections exports.
Important terms regarding LinkedIn use:
- RememberPeople is an independent application and is not affiliated with, endorsed by, or sponsored by LinkedIn Corporation or its parent company Microsoft.
- The in-app LinkedIn browser displays LinkedIn's website using the same mechanism as a standard mobile browser. Your use of LinkedIn within this browser is governed by LinkedIn's User Agreement and Privacy Policy.
- You are responsible for ensuring your use of LinkedIn's data complies with LinkedIn's User Agreement and applicable law.
- The App uses client-side JavaScript for extraction of publicly visible info (name, headline, role, company) when you tap "Capture". No automated bulk scraping is performed.
- We do not access, store, or transmit your LinkedIn credentials or session data.
9.3 No Third-Party Analytics or Advertising
The App does not integrate with third-party analytics platforms, advertising networks, or data brokers.
10. Disclaimers and Limitations of Liability
10.1 "AS IS" Disclaimer
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
10.2 No Guarantee of Memory Outcomes
The spaced-repetition and memory features in the App are tools to support recall. We make no guarantee that using the App will improve your memory or relationship outcomes.
10.3 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY SHALL NOT EXCEED AUD $50.00.
14. Dispute Resolution
14.1 Governing Law
These Terms are governed by the laws of Australia, specifically the state of New South Wales, without regard to conflict of law principles.
14.2 Informal Resolution
Before filing a formal claim, you agree to contact us at office@keepingupwithtechnology.com to attempt to resolve the dispute informally within 60 days.
